These Digital Wallet Terms and Conditions govern the use of your First Mid card in conjunction with any Digital Wallet service, including Apple PayTM, Samsung PayTM, Google PayTM or any other service that allows the use of your First Mid card (“Card”) in an electronic format without presenting the Card itself. These Digital Wallet Terms and Conditions (“Terms”) are in addition to, and supplement your existing Debit Card Agreement.
In these Terms, “you” and “your” refer to the cardholder and “we”, “our” and “us” refer to First Mid. “Device” means any electronic device that you choose to use to digitize your Card for processing payments, such as mobile phones, tablets, computers, or other compatible hardware.
These Terms are a legal agreement between you and First Mid. Please read these Terms carefully before setting up or using your Card in a Digital Wallet. Use of your Card through a Digital Wallet is your acceptance and agreement to these Terms.
- Eligibility and Enrollment
You can set up eligible Cards to certain Digital Wallets by following the instructions of the Digital Wallet provider; however you may not be able to be set up a Card on all Digital Wallets or Devices. If your Card or underlying account is not in good standing, or is no longer in good standing, that Card may not be eligible to enroll or use in your Digital Wallet. The Digital Wallet may not be accepted at all places where your Card is accepted.
To authenticate your Card, or if we suspect that there may be fraud associated with the Card, we may send a One Time Passcode (“OTP”) to your wireless phone number, email address or other delivery point that we have in our records. We do not charge for the OTP message, but your data service provider’s or wireless carrier’s message and data rates may apply. We are not liable for losses or damages from non-delivery, delayed delivery, or misdirected delivery of the OTP.
- Existing Terms and Conditions
Terms and conditions expressed in your Debit Card Agreement do not change and remain in effect when you add your Card to a Digital Wallet. Any interest, fees, and charges that apply to your Card will apply when your Card is used to make payments or purchases through a Digital Wallet.
Your use of the Digital Wallet is also subject to applicable agreements or terms of use with your Device provider or other parties.
- Digital Wallet Responsibility
The Digital Wallet is a service offered exclusively by your Device provider. We are not responsible for your Digital Wallet. We are not responsible for the proper operation of the Digital Wallet or your ability, or inability, to use the Digital Wallet or Device for any transaction.
You are solely responsible for maintaining the confidentiality of your Digital Wallet login information, including your user name and/or passwords associated with the Device or Digital Wallet. If you share these credentials with any other person, they may be able to use your Card.
- Fees
We do not charge a fee to set up or use your Card in a Digital Wallet or Device. However, the Digital Wallet provider, Device provider, wireless carrier or other third parties may charge you fees. You are solely responsible for all such fees and agreements set forth by any other third party providers.
- Privacy
In order to set up your Card in a Digital Wallet we may share the information needed to do so with the provider of the Digital Wallet, payment network or others to fulfill your request. Please review our privacy policy online at https://www.firstmid.com. Any information you disclose to your Device provider or any other third party is subject solely to their security policies and governed by their respective privacy policies and not the First Mid privacy policy applicable to your Card or the underlying account.
- Electronic Notices and Changes to these Terms
You consent to receive electronic communications and disclosures from us in connection with your Card, your Digital Wallet and/or your Device. We reserve the right to revise these Terms at any time by posting the updated document on our website or through other electronic notice.
- Lost or Stolen Devices or Cards
If your Device is lost or stolen, or you have reason to believe that your Device has been compromised, including that of your fingerprint reader, PIN, or other security device, contact us immediately so that we can take action to disable your Card for use within the Digital Wallet. If you fail to notify us, you may be liable for all or a portion of the losses associated with unauthorized use of your Card whether that use was through your Digital Wallet or not.
- Removing Your Card from the Wallet
To remove your Card from your Digital Wallet, follow the required process in the Digital Wallet and/or Device. We may at any time and for any reason, block, suspend, terminate, or discontinue support and/or use of a Card, or all Cards, in a Digital Wallet, except as otherwise prohibited by applicable law.
- Governing Law and Disputes
These Terms are governed by federal law and, to the extent that state law applies, the laws of the state that apply to the agreement under which your Card is covered. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures in your Debit Card Agreement.
